Copyright Compliance Policy
This Copyright Compliance Policy governs how Rate My Instructor responds to claims of copyright infringement on our website, applications, and related services.
Copyright Protection Overview
We respect intellectual property rights and expect users to do the same. We act expeditiously on properly formatted notices and have a repeat-infringer policy.
1How to Send a Notice of Alleged Infringement (DMCA Notice)
If you are a copyright owner or an authorized agent and believe content on the Site infringes your copyright, send a written notice that includes all items below. Incomplete notices may not be processed.
Send to our Designated Agent:
Name: DMCA Agent – Rate My Instructor
Address: Rate My Instructor, Inc., [Street], [City, State ZIP], [Country]
Email: dmca@ratemyinstructor.io (preferred)
Important: Use this contact only for copyright claims. Customer support or other inquiries sent here will not receive a response.
Your notice must include:
- A physical or electronic signature of the copyright owner or authorized agent.
- Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered.
- Identification of the material claimed to be infringing (or the subject of infringing activity) that you want removed or disabled, with information reasonably sufficient for us to locate it (e.g., exact URL(s), screenshot, and any relevant context).
- Your contact information: full name, mailing address, phone number, and email address.
- A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf.
Misrepresentation Notice
If you knowingly misrepresent material as infringing, you may be liable for damages (including costs and attorneys' fees).
Upon receipt of a valid notice, we will remove or disable access to the identified material and notify the user who posted it.
2How to File a Counter-Notification
If your content was removed due to a DMCA notice and you believe the material was removed as a result of mistake or misidentification, you may submit a counter-notification to our Designated Agent.
Your counter-notification must include:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location where the material appeared before removal (e.g., exact URL).
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled due to mistake or misidentification.
- Your name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or any judicial district in which RMP may be found if you reside outside the United States), and that you will accept service of process from the person who provided the original DMCA notice or that person's agent.
After we receive a compliant counter-notification, we may forward it to the original claimant. We may restore the material no earlier than 10 business days and no later than 14 business days after sending the counter-notification, unless we are informed that the claimant has filed an action seeking a court order to restrain you from engaging in infringing activity. Restoration remains at our discretion and subject to our Terms of Use and community guidelines.
Misrepresentation Notice
If you knowingly misrepresent that material was removed by mistake or misidentification, you may be liable for damages (including costs and attorneys' fees).
3Repeat Infringer Policy
We may, in appropriate circumstances and at our discretion, terminate user accounts that are repeat infringers. Generally, a "repeat infringer" is a user who posts content that is the subject of two or more valid DMCA notices.
If your account is terminated under this policy, you agree not to attempt to create a new account. Attempting to re-register may result in additional actions and liability.
4Removal, Discretion, and No Waiver
Rate My Instructor may remove or disable access to any content at any time for any reason, with or without notice, consistent with our Terms of Use and community rules.
Our handling of a particular notice or counter-notification does not waive any of our rights, remedies, or defenses.
Nothing in this Policy limits our ability to comply with applicable law, to cooperate with law enforcement, or to protect our users and the public.
5Non-U.S. Notices
This Policy follows the U.S. Digital Millennium Copyright Act (17 U.S.C. §512) framework. If you are outside the United States, you should still submit notices using the requirements above. We may also consider notices made under other applicable laws.
6Sole Statement
This document is the sole statement of our Copyright Compliance Policy for the Site. No other statement (including summaries or machine-generated versions) is valid.
